Rutherford County Criminal Defense Attorney

Rutherford County is the one county in this area where the arresting agency decides which courthouse you report to. Smyrna has kept its own criminal court, and all four of the county's recovery courts gate on a risk assessment plus a minimum amount of probation left. A Rutherford County criminal defense attorney has to know which of those applies before the first setting.

How Criminal Cases Work in Rutherford County

Rutherford County sits in the 16th Judicial District with Cannon County. Felonies go to Circuit Criminal Court, a division of Circuit Court, rather than to a separate Criminal Court. General Sessions has three judges. But the first question is not which court — it is which agency wrote the charge.

Read the distinction carefully, because it is not simply the name on the badge. Smyrna is the unusual one: its court holds concurrent General Sessions authority over state criminal law inside the town limits and conducts preliminary hearings in felony cases, so a Smyrna officer's state charge stays in Smyrna. Murfreesboro City Court and La Vergne City Court handle city citations. A state criminal charge filed by Murfreesboro or La Vergne police goes to county General Sessions like any other. Tennessee Highway Patrol and Sheriff's Office cases go there too. Several agencies, several buildings, and the wrong assumption costs you a court date. La Vergne runs a city court at 5093 Murfreesboro Road, which handles citations written by La Vergne police and sits on the second, third and fourth Wednesdays at 2:30 p.m., except in November and December, when it sits the first and second Wednesdays only. Eagleville runs one as well, at City Hall, typically the second Tuesday of the month.

Most cases start in General Sessions, and that court has a hard ceiling. Under § 40-1-109 it can enter final judgment only in a misdemeanor, and only where the defendant waives indictment, presentment, grand jury investigation and a jury trial in writing. A felony cannot be tried there at all. Section 40-3-101 allows a criminal charge to be answered only by presentment, indictment or impeachment, so at the General Sessions stage a felony gets a preliminary hearing and a bind-over rather than a trial.

Three things worth knowing. Not every case passes through General Sessions at all — a grand jury presentment or a direct indictment starts the case in the higher court, and someone arrested on an indictment has already skipped the stage this page describes. Waiving the preliminary hearing is not unilateral either: under § 40-10-114 the State can block a waiver by making a timely objection for good cause. And a felony can skip the grand jury by information under § 40-3-103, but only with the defendant's written waiver made in the presence of counsel, and only with the court's consent.

Recovery and Specialty Courts in Rutherford County

These programs are demanding rather than easy, and admission is never automatic. They are worth asking about early, because several of them turn on facts that get decided during plea negotiations rather than after.

Programs available to Rutherford County defendants
ProgramWhat is published about it
Recovery Court Listed at both the Circuit and General Sessions levels. Requires residence in the district, no violent charges, a documented substance abuse history, all other legal matters resolved, at least eighteen months remaining on probation, and a high risk and high need score on the state assessment
DUI Treatment Court Requires a second or higher DUI offense, at least twelve months remaining on probation, and a moderate risk and moderate need score
Mental Health Court Requires a documented history of severe and persistent mental illness, high risk and high need scoring, and eighteen months remaining on probation if already on probation
Veterans Treatment Court Two tracks. Track 1 needs twelve months of probation remaining and moderate scoring; Track 2 needs eighteen months and high scoring. Veteran or active duty status, no violent charges, residence in the district

Eligibility criteria come from the courts' own published materials and from the state's treatment court roster. Programs change their criteria, and not every program publishes them, so treat this as the starting point for a conversation rather than as a decision.

Local Practice

The Rutherford County Details That Actually Change Your Case

  1. Smyrna kept its criminal court, and the voters said so

Smyrna is one of very few Tennessee towns that still runs its own criminal court. A March 2024 referendum on stripping that jurisdiction failed by better than two to one, 3,329 votes to 1,332. The practical result is that a state-law arrest by a Smyrna officer is heard in Smyrna at 400 Enon Springs Road East, not in Murfreesboro, and Smyrna's own judicial commissioners set the bond.

  2. Every recovery court here gates on how much probation you have left

This is the most important strategic fact in the county. Recovery Court and Mental Health Court need eighteen months remaining. DUI Court and the first veterans track need twelve. All four also use the state risk and needs assessment as a hard threshold, and each requires a different score band. That means the length of the probationary sentence you negotiate directly decides which doors stay open. A shorter probation can look like a better deal and quietly close the program you actually wanted.

  3. Dockets are split by last name

The county publishes that its Domestic Violence Court runs daily Monday through Friday dockets divided among the three General Sessions judges by defendant's last name. Which judge you see is not random and it is not chosen.

  4. There is a courtroom inside the jail

General Sessions sits at the Adult Detention Center as well as at the Judicial Building, and the Sheriff's Office transports roughly 600 inmates a month to hearings.

Common Questions

Rutherford County Questions

Why is my case in Smyrna instead of Murfreesboro?

Because a Smyrna police officer charged you. Smyrna's court holds concurrent General Sessions authority over state criminal violations inside the town limits and handles preliminary hearings in felony cases, so those cases stay in Smyrna at 400 Enon Springs Road East. The town kept that jurisdiction in a 2024 referendum, 3,329 votes to 1,332. This is what makes Smyrna different from Murfreesboro and La Vergne, whose city courts handle city citations rather than state charges.

Murfreesboro police wrote my ticket. Where does that go?

Murfreesboro City Court, if it is a city citation. A state criminal charge from Murfreesboro police goes to county General Sessions, and so does anything written by Tennessee Highway Patrol or the Sheriff's Office. La Vergne runs its own city court for La Vergne police citations. Rutherford County is the one place in this area where the agency on the paperwork is the first thing to check.

How much probation do I need for recovery court?

It depends which one. Recovery Court and Mental Health Court require at least eighteen months remaining. DUI Court requires twelve, and it requires a second or higher DUI offense. Veterans Treatment Court has a twelve-month track and an eighteen-month track with different risk scoring. This is why the length of a probationary sentence should be negotiated with the program in mind rather than settled first and asked about later.

Does Rutherford County have a separate Criminal Court?

No. Felonies are heard in Circuit Criminal Court, which is a division of Circuit Court. The county is in the 16th Judicial District along with Cannon County.
